Guardianship & Administration Orders
We support clients with guardianship and administration matters.
Our lawyers can provide advice, support and representation in the State Administrative Tribunal if you are subject of a Guardianship or Administration Order application, or current order and wish to seek a review or vary the order.
A guardian makes decisions about living arrangements, legal affairs and lifestyle, including medical treatment.
An administrator makes decisions about finances and property.
These arrangements are put in place if the Tribunal believes you not capable of making reasonable decisions in your own best interests.

Can we help you?
We can help you if:
- You are the subject of a current guardianship and/or administration order;
- You are the subject of an application to make a guardianship and/or administration order;
- You have a diagnosed mental illness, or you have been treated under the Mental Health Act 2014.

What legal issues can we help with?
Our team provides legal advice on all aspects of the Guardianship and Administration Act 1990, including opposing, reviewing, changing or cancelling a guardianship or administration order.
- When an order is first put in place, our lawyers can provide legal advice and represent you in before the SAT to contest or disagree with an application.
- When an order is reviewed by the SAT, which must occur at least every five years or earlier if your circumstances change, we can provide legal advice and represent you before the Tribunal if needed.
How much time do we need?
We need seven working days’ notice to assist with guardianship and administration matters.

Guardianship and Administration
A Guardianship Order can be put in place to help a person make important personal life decisions when they cannot do so themselves, usually because they have amental illness or disability. The Mental Health Law Centre can help you with legal advice and representation if you are the subject of a Guardianship Order application or your Guardianship Order is being reviewed by the State Administrative Tribunal.
Administration Orders
An Administration Order can be put in place to help a person manage their financial affairs when they cannot do so themselves, because they have a mental illness or disability. The MHLC can help you with legal advice and representation if you are the subject of an Administration Order application or your Administration Order is being reviewed by the State Administrative Tribunal.
